Terms of Service

Attorney Review Notice: These Terms of Service are a template prepared for informational purposes. They should be reviewed and approved by a licensed Virginia attorney before publication to ensure compliance with Virginia law and to adequately protect Alcove’s interests.

1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Alcove Home Management (“Alcove,” “we,” “our,” or “us”), a home operations management company based in Charlottesville, Virginia.

By accessing our website at getalcovehome.com (the “Site”), submitting a consultation request, enrolling as a member, or using any of our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or services.

2. Description of Services

Alcove provides home operations management services to homeowners in Charlottesville and Central Virginia. Our services include, but are not limited to:

  • Home condition assessment and maintenance planning
  • Vendor identification, vetting, and coordination
  • Scheduling and oversight of maintenance and repair work
  • Preventative maintenance management
  • Documentation and record-keeping of home service history
  • Emergency intake and vendor dispatch (on applicable membership tiers)
  • Communication and reporting to members

Important: Alcove is a management and coordination service. We do not perform trade work, construction, or contractor services directly. All physical work on your property is performed by independent, licensed, and insured vendors in our Preferred Partner network or vendors you designate. Alcove is not responsible for the workmanship, materials, or conduct of third-party vendors, though we take reasonable steps to vet all partners and follow up on completed work.

3. Membership and Enrollment

Eligibility: Alcove membership is available to property owners of residential properties located within our service area. You must be at least 18 years of age to enroll.

Membership Tiers: Alcove offers three membership tiers — Essentials, Complete, and Estate — each with defined services and pricing. The specific services included in your tier are described in your Membership Agreement. Tier availability and pricing are subject to change with 30 days’ prior written notice to existing members.

Onboarding: Enrollment becomes effective upon execution of a Membership Agreement and receipt of the first membership fee payment. Your Home Manager will contact you within one business day to initiate onboarding.

Account Responsibility: You are responsible for maintaining accurate contact and property information. Please notify us promptly of any changes to your phone number, email, home address, or property access arrangements.

4. Fees and Payment

Membership Fees: Membership fees are billed monthly on the date of enrollment. Fees are due in advance for each billing period. Current pricing is published at getalcovehome.com/pricing.

Vendor and Contractor Costs: Membership fees cover Alcove’s management, coordination, and oversight services only. Costs for vendor labor, materials, parts, and contractor services are separate and billed directly by the applicable vendor or passed through to you with your advance approval. Alcove will not authorize any work on your behalf without your prior consent.

Late Payments: Accounts with overdue membership fees may be suspended after 10 days. Alcove reserves the right to charge a late fee of up to 1.5% per month on overdue balances.

Refunds: Membership fees are non-refundable for the current billing period. No refunds are issued for partial months.

5. Term and Cancellation

Initial Term: All memberships require an initial 12-month commitment beginning on the enrollment date.

Renewal: After the initial term, memberships renew automatically on a month-to-month basis until cancelled.

Cancellation by Member: You may cancel your membership after the initial term by providing 30 days’ written notice to info@getalcovehome.com. Your membership will remain active through the end of the final paid billing period.

Early Termination: Cancellation during the initial 12-month term will result in an early termination fee equal to two months of membership fees at your current tier rate, unless termination is due to a material breach by Alcove that has not been cured within 14 days of written notice.

Cancellation by Alcove: Alcove reserves the right to terminate membership for non-payment, breach of these Terms, or conduct that is abusive, fraudulent, or harmful to our staff, partners, or other members. In such cases, we will provide written notice and a reasonable opportunity to cure where appropriate.

6. Member Responsibilities

As a member, you agree to:

  • Provide accurate and complete information about your property
  • Maintain safe and reasonably accessible conditions for vendors performing work
  • Respond to communications from your Home Manager within a reasonable timeframe
  • Approve or decline proposed work within the timeframe communicated by Alcove
  • Pay all vendor invoices and approved expenses in a timely manner
  • Notify Alcove of any emergency situations requiring immediate attention
  • Not contact Alcove’s Preferred Partners directly to circumvent the management relationship during your membership

7. Preferred Partner Network

Alcove maintains a network of vetted, licensed, and insured vendors (“Preferred Partners”). While Alcove takes reasonable steps to vet Preferred Partners, we do not guarantee their work and are not liable for the quality, timeliness, or outcome of services performed by third-party vendors. All vendor services are subject to the vendor’s own terms, warranties, and licensing.

Alcove does not accept kickbacks, referral fees, or other compensation from Preferred Partners. Our partner relationships are based on quality, reliability, and fit with our members’ needs.

8. Limitation of Liability

To the maximum extent permitted by applicable Virginia law, Alcove’s total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the total membership fees paid by you in the three months preceding the claim.

Alcove shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to property damage, loss of use, or economic losses, even if Alcove has been advised of the possibility of such damages. This limitation applies to claims arising from vendor conduct, delays in service, system failures, or force majeure events.

Nothing in these Terms limits liability for gross negligence, willful misconduct, or fraud.

9. Indemnification

You agree to indemnify, defend, and hold harmless Alcove and its employees, contractors, agents, and partners from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of our services; (b) your breach of these Terms; (c) any inaccurate information you provide; or (d) any access to your property that you authorize.

10. Intellectual Property

All content on the Site, including text, graphics, logos, and service descriptions, is the property of Alcove Home Management and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.

11. Confidentiality

Both parties agree to keep confidential any non-public information shared in the course of the service relationship. Alcove will not disclose your property information, service history, or personal details to third parties except as described in our Privacy Policy or as necessary to deliver services.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved first through good-faith negotiation. If negotiation is unsuccessful, disputes shall be submitted to binding arbitration in Charlottesville, Virginia, under the rules of the American Arbitration Association, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction.

You waive any right to participate in a class action lawsuit or class-wide arbitration against Alcove.

13. Changes to These Terms

We may update these Terms from time to time. We will notify current members of material changes via email at least 30 days before the effective date. Your continued use of our services after the effective date of any changes constitutes acceptance of the updated Terms.

14. Entire Agreement

These Terms, together with your executed Membership Agreement and our Privacy Policy, constitute the entire agreement between you and Alcove regarding the subject matter herein and supersede all prior agreements or understandings.
